This article references the Terms and Conditions for changing subscription plans.
BiznessApps’ Partners under new plans Standard, Gold or Platinum can only downgrade plans on the anniversary of the contract; while an upgrade can be done anytime.
The Terms and Conditions below are taken from the signed contract which covers term & cancellations etc. Further terms can be found at BiznessApps Terms of Service.
Special Terms Upon execution of this Quote, Reseller and Service Provider will be parties to a legally binding contract consisting of: this Quote, the Terms of Service, and the Support Terms and Conditions located at: https://www.biznessapps.com/legal (collectively, the “Subscription Agreement”). In the event of conflict, the terms of this Quote will supersede the Terms of Service or the Terms of Support. The Subscription Plan indicated above represents the level of support to be made available by the Service Provider under the Support Terms and Conditions. The “Term” means the Term Start Date through the Term End Date set out above. The Term indicates the duration of the license to access the Services and receive the support services according to the Subscription Plan. The parties agree as follows:
- Reseller agrees to pay the Total Fees Due as indicated above. In case of recurring billing, Reseller will be automatically charged in each calendar month/year(s) in accordance with the terms of its chosen Subscription Plan.
- Reseller’s obligations may not be cancelled prior to expiration of the Term. The fees are paid in advance, non-refundable and exclusive of all taxes, levies, or duties imposed by the taxing authorities. Reseller is responsible for any taxes levies, or duties imposed by the taxing authorities.
- The number of Apps included in each Subscription Plan is set out above. a. If Reseller does not use the number of Apps included in its Subscription Plan, Reseller will still owe the Annual Plan Subscription Fee. b. If Reseller exceeds the number of Apps included in its Subscription Plan, Reseller can purchase extra Apps credits for the fees set out under the Volume App Credit Pricing table above. For example, if Reseller selected the Platinum Support Plan and has 65 Apps published, the first 20 Apps fall in the Reseller base package, the remaining 45 Apps will be charged per App according to the volume App Credit Pricing table. The total monthly cost = Platinum Support Subscription Fee + (45 App credits * price per App). All Apps must be under the same Subscription Plan selected. Reseller may also order additional Apps via the online portal.
- Reseller may order services not included in its Subscription Plan as set out under the Additional Fees table above.
- SUBJECT TO EARLY TERMINATION IN ACCORDANCE WITH THE SUBSCRIPTION AGREEMENT, THE TERM WILL AUTOMATICALLY RENEW FOR THE SAME TERM PERIOD AS THE TERM SELECTED ABOVE AT SERVICE PROVIDER’S CURRENT RATES, UNLESS RESELLER NOTIFIES SERVICE PROVIDER IN WRITING OF RESELLER’S INTENT NOT TO RENEW AT LEAST SIXTY (60) DAYS PRIOR TO THE EXPIRATION OF THE THEN-CURRENT TERM.
- The provisions of the Subscription Agreement constitute the entire agreement between the parties regarding the subject matter hereof and supersede all proposals, prior agreements, oral or written, and all other communications with respect thereto. No terms and conditions on any purchase order or other document exchanged by the parties will be deemed to modify or amend the Subscription Agreement.
- This Quote may be executed in counterparts, each of which will be deemed an original but all of which together constitute one and the same instrument. An electronic signature of such will constitute execution by such signatory.
This states that the contract is in place for the term of the agreement which means that BiznessApps’ Partners can only change their subscription at the end of the term.
